Tiburon, California, is set to become only the third city in the United States to ban the sale of all tobacco products, after Beverly Hills and Manhattan Beach. The Marin County council’s unanimous vote Wednesday night received applause. The move signals a decisive step toward implementing one of the country’s most extensive tobacco bans.
The ordinance — which includes cigarettes, e-cigarettes, cigars, and nicotine pouches — was not proposed by health officials or lawmakers but by three students at Redwood High School. The teens contacted local leaders after noticing widespread vaping among classmates.
Tiburon Mayor Holli Thier said youth vaping is a particularly severe problem in Marin County. “Youth in Marin County vape at twice the average in the state of California. This is a serious issue,” she said.
Public health advocates praised the move as a logical next step for a state already known for strict tobacco restrictions. Dr. John Maa of the San Francisco Marin Medical Society told local media that the precedent set by Beverly Hills’ 2021 tobacco sales ban showed “a reduced smoking incidence” after its implementation.
Although Tiburon currently has no tobacco retailers, supporters argue that implementing a sales ban now will stop future outlets from opening. Critics, however, see the measure as an unnecessary overreach — a symbolic policy for a town that doesn’t currently sell the products it’s banning.
The ordinance will go back to the Town Council in November for a final vote. If approved, it will become effective in December 2025.
The nearby towns of Ross, Belvedere, and Corte Madera are reportedly examining similar proposals, indicating that Marin County might soon serve as a regional example for tobacco-free retail zones.
Tiburon’s action follows a broader national shift toward generational and local sales bans. In Massachusetts, several towns — including Brookline, Hopkinton, Newton, Belchertown, and South Hadley — have enacted “tobacco-free generation” laws, barring tobacco and nicotine sales to anyone born after a set date.
Brookline’s ordinance, upheld by the Massachusetts Supreme Judicial Court earlier this year, has become a model for such efforts.
