The government adopted a bill introducing a ban on the sale of all disposable and reusable e-cigarettes to minors, including nicotine-free ones and nicotine pouches, informed the Minister of Health Izabela Leszczyna.

At the conference after the meeting of the Council of Ministers, Leszczyna said that the draft amendment to the Act on the Protection of Health against the Consequences of Using Tobacco and Tobacco Products also introduces a ban on the use of e-cigarettes without nicotine under the rules applicable to e-cigarettes with nicotine. 

The ban on sales to minors will include: tobacco products, nicotine pouches, electronic cigarettes and refill containers, according to media reports 

Leszczyna stated that currently, disposable and reusable e-cigarettes can be purchased, among others places, in vending machines near schools. She added that the Ministry of Health project includes a ban on the sale of e-cigarettes without nicotine in vending machines, remotely – including via the Internet and a ban on advertising. The same rules are to apply to nicotine pouches. 

Nicotine-free e-cigarettes will not be allowed to be used in public places where there is currently a ban on the use of electronic cigarettes with liquid containing nicotine, for example, on the premises of schools, at public transport stops, or in public playgrounds. 

The head of the Ministry of Health pointed out that until now, nicotine-free liquids were not subject to notification to the Office for Chemical Substances. After the changes, the composition of the liquid (both nicotine-free and nicotine-based) will have to be adapted to current regulations.
