The U.S. Food and Drug Administration has ordered 28 cigarette products manufactured by Seneca Manufacturing Company off the U.S. market, issuing final Not Substantially Equivalent (NSE) determinations under the Tobacco Control Act.

The products—sold under the Heron and Sands brand families—were previously allowed to remain on shelves as “provisional” substantial equivalence (SE) products while FDA reviewed their applications. That review has now concluded.

“With the posting of these final NSE decisions, these tobacco products can no longer be distributed, imported, sold, or marketed in the United States,” the agency said.

The styles include:

The action immediately removes those products from the legal marketplace, though regulators are offering a short transition period for retailers. FDA said it does not intend to take enforcement action against retailers for at least 30 days from the posting date, with a compliance deadline of May 23, 2026.

After that, continued sales could trigger enforcement actions, including warning letters, civil monetary penalties, product seizures, or injunctions. The move is part of a broader effort to resolve a backlog of provisional products that entered the market before the 2009 Family Smoking Prevention and Tobacco Control Act.

Under that framework, tobacco products introduced between February 2007 and March 2011 could remain on the market while the FDA evaluated whether they were “substantially equivalent” to products already commercially available.

If they fail to meet that standard, they are issued NSE orders, effectively removing them from legal sale. The affected portfolio spans multiple variants, including red, gold, and menthol styles, across both box and soft pack formats in king and 100s sizes.

FDA is also directing retailers to coordinate with manufacturers or suppliers to determine how to dispose of remaining inventory. To support compliance, the agency cited its Searchable Tobacco Products Database, which now lists more than 17,400 products that may be legally sold in the United States.
